We act for both creditors and debtors in connection with the presentation and defence of bankruptcy and winding up proceedings. If the debt is disputed our lawyers will seek the dismissal of the petition or if necessary take steps to ensure a Winding up Petition is not advertised by securing an injunction.
Very often an individual or business is in a position to pay a debt at some point in the future once assets are realised but where current cash flow problems have led to the issue of the petition. In these circumstances our lawyers can advise on the best way of resolving the issue with the creditor which may involve adjournments to allow for assets to be sold or by offering security to the creditor.
Our experience includes
- Acting for a recruitment company in connection with the collection of a substantial debt of circa £300K from a well known facilities management company which, several weeks after having paid the debt, was placed into administration
- Acting for a recruitment company in connection with the collection of £50K from an engineering company following the service of a Winding up petition (in addition to the collection of a further £40K via the service of statutory demands on four associated companies).
- Acting for a leisure company in connection with the successful defence of a winding up petition served on it where the debt was disputed on substantial grounds and where the creditor had bought parallel proceedings in the County Court for possession of a secured property.
