What can we DO to help?
We can assist you with disputes concerning residential or business tenancies involving:
• Recovery of rent and service charge arrears
• Termination and recovery of possession
• Forfeiture and relief from forfeiture
• Dilapidations
• Breach of covenant, including disrepair
• Renewal of business tenancies
We can also assist you with disputes about rights concerning property, land and buildings, which usually arise between neighbouring landowners. Such disputes most commonly relate to:
• Boundary positions
• Adverse possession claims (‘squatting’)
• Easements, including rights of way
• Breach of freehold covenants
• Trespass and nuisance
• Party walls
• Access to neighbouring land to carry out works
We understand that these ‘territorial’ disputes, whatever the scale, have the tendency to become hard-fought and bitter affairs. We act quickly to protect our clients’ interests, for example, by applying for an interim injunction where there is an imminent risk of damage to property. However we do not encourage clients to engage in a war of attrition and prefer to seek creative, cost effective solutions to these types of disputes.
When settlement cannot be reached, we will prepare your case thoroughly either for Court or, if applicable, for the appropriate tribunal, such as the Adjudicator to HM Land Registry, the Leasehold Valuation Tribunal or the Upper Tribunal (Lands Chamber).
