Enforcement

We can advise in relation to enforcement proceedings, breach of condition notices and stop notices and the methods of appeal.

Generally, a breach of planning control is not in itself an immediate problem until an enforcement notice is served. If an enforcement notice is served, you must act quickly, either to comply or appeal against the notice to avoid criminal prosecution.

Once you receive an enforcement notice we can advise and prepare the appeal itself, buying time, where necessary to enable you to negotiate with the council and secure planning permission, where possible. We can conduct the appeal, by way of written representations, an informal hearing or a public inquiry, on your behalf and assist in the negotiations.

We can also advise and challenge stop notices and breach of condition notices, and represent in the magistrates court for breaches of a tree preservation order, and unauthorised works (including demolition) on a listed building.
