The concept of a common law marriage is a myth. Cohabiting couples are unable to benefit from the usual financial remedies available to divorcing couples. Currently the resolution of financial disputes between cohabitees is governed by complex and often archaic principles of property, trust and contract law. Where a relationship between a cohabiting couple breaks down, the division of assets can be complicated especially when, for example, property is held in one party’s sole name.
When you and your partner decide to live together it is therefore advisable to prepare a Living Together agreement. The agreement will set out the basis upon which you intend your assets, including your property to be divided should you and your partner decide to split-up.
