Frequently Asked Questions

It is the executors duty to carry out the terms of the Will, and put the deceased's wishes in place.

To do this, they must firstly ascertain all the assets and liabilities of an estate to see whether a Grant of Probate is going to be required to administer the estate.

The Grant of Probate is the document issued by the Court giving the Executors authority to deal with the deceased’s assets.

Then their estate is administered in accordance with the Intestacy Rules. The Grant of Letters of Administration is the document issued by the Court giving the Administrators authority to act in the administration of the estate.

The Administrator(s) is/are the person(s) who is/are entitled to benefit from the deceased’s estate in accordance with the Intestacy Rules.  For more details  see 'Protecting Your Loved Ones After You've Gone' in the Downloads section.
