Our specialist lawyers advise on all aspects of credit, debt recovery and insolvency. We can help you put in place robust credit procedures so as to minimise your exposure to bad debt, ensure compliance with your invoice financing and credit insurance terms and maximise the prospects of a recovery in the event of unpaid invoices.
Our debt recovery team is experienced at recovering monies owed to the Recruitment Sector both pre and post the issue of proceedings. We use civil enforcement and the insolvency process effectively to, wherever, possible, promptly recover the value of your outstanding invoices. By using late payment legislation we can make the debt recovery process self funding and sometimes even profitable, returning additional funds to you to help fund our client’s internal credit control costs.
When you are facing an insolvent debtor we work with our network of insolvency practitioners to maximise the return that you receive from the debtor’s insolvency. We will usually work with insolvency practitioners on a conditional fee or no win/no recovery fee basis. Our involvement often creates better results for our clients even if we have not commenced insolvency proceedings against the debtor as the Recruitment Sector is often a major creditor giving it rights to control who gets appointed as liquidator or the terms of a voluntary arrangement proposed by a company.
If your own business is facing cash flow difficulties we work with insolvency and restructuring advisers to help rescue the company or minimise the deficiency to your creditors and shareholders through an orderly winding down of your affairs.
Our experience includes:
- Recovering over £120,000 for a medium sized Employment Agency from a services company which was subsequently placed into administration.
- Recovering £100,000 for a Recruiter 100 Recruitment Sector business from 5 separate associated divisions of an engineering company that had defaulted following its own financial problems.
- Recovering £0.5million for a Top 10 Recruiter 100 Recruitment Sector business where the debtor was based in Scotland.
- Advising a medium sized Employment Agency in respect of a £300,000 debt owed by a well known retailer where the agency’s credit insurance was an issue.
- Acting on a conditional fee agreement for the liquidator of a debtor that owed substantial sums to a Top 10 Recruitment Sector client where the Directors were asked to pay monies back to the liquidator because of their wrongful trading.
- • Handling approximately 1500 routine claims for unpaid invoices.
