Recruitment Fee Disputes

 

Fee disputes are common within the Recruitment Sector caused often by clients either not understanding or trying to avoid their contractual responsibility. In the former case our understanding and experience of such disputes allows us to resolve disputes promptly and at minimal cost to our clients. Where proceedings are necessary we often obtain summary judgment shortly after the issue of proceedings so as to avoid protracted litigation.

Our experience of Employment Business fee disputes includes non-disclosed engagements or “backdoor cases”, disputed Transfer Fees, disputed third party engagements and disputed permanent introduction fees. We also advise Employment Businesses in respect of specialist sector disputes such as health and social care.

Our experience of Employment Agency fee disputes includes rates disputes, set off disputes arising out of losses caused by temporary workers and cases where the client has failed to sign timesheets. We also advise Employment Agencies in respect of specialist sector disputes such as those involving agency drivers.

Our experience and understanding of the RPO and MSP models have enabled us to resolve a number of disputes arising out of failed RPO and MSP implementation that has left our clients with large sums due by FTSE 100 companies and local authorities.

We also advise our valued commercial client bases in relation to disputes with the Recruitment Sector in respect of similar matters.

Our experience includes

• Advising a Recruiter 100 client in respect of a dispute with a local authority arising out of failed implementation by the local authority of RPO. The case involved over 450 invoices and accounting adjustments.
• Acting for a Recruiter 100 client in respect of a claim against a well known MSP arising out of failed implementation by a FTSE 100 client of RPO.
• Acting for Recruitment Sector clients in approximately 200 disputed Transfer Fee cases including cases involving the Conduct of Employment Agencies and Employment Businesses Regulations 2003.
• Acting for an agency specialising in drivers in respect of disputes arising out of damage caused to vehicles and property by temporary workers.
• Acting for Recruitment Sector clients in respect of cases involving alleged fraudulent or negligent completion of time sheets by temporary workers.
