The recent economic climate and consolidation within the Recruitment Sector has led to an increase in RPO and the use by large corporate of MSP. Companies engage in RPO, often by using a Managed Service Provider (MSPs), so as to better control staff and recruitment costs and mitigate risk. With the Agency Worker Regulations 2010 coming into force in October 2011 RPO and the use of MSPs is set to increase.
Our recruitment specialists advise on all aspects of outsourcing including the contracts and relevant employment law issues such as TUPE. Working with specialist third party advisers we can advise on VAT mitigation and issues surrounding PAYE and NIC.
Where disputes arise out of RPO and MSP our experience assists with the prompt resolution of the disputes without protracted and costly litigation.
Our experience includes:
- Advising an English subsidiary of a Japanese multinational in respect of issues surrounding the outsourcing of staff.
- Advising a Top 100 Recruitment Sector client in respect of a dispute with an MSP over a significant number of unpaid invoices leading to a successful recovery.
- Advising another Top 100 Recruitment Sector client in respect of disputes with end user clients arising out of the end user client’s failure to properly implement RPO/MSP arrangements.
- Advising a number of Recruitment Sector clients who were experiencing difficulty in recovering fees from local authorities following the failed implementation, by the local authority of RPP/MSP.
